This WordPress Hosting Terms of Service (“Agreement”) is entered into between the hosting provider (“Provider,” “we,” “us,” or “our”) and the individual or entity (“Customer,” “you,” or “your”) using our WordPress hosting services. This Agreement governs your use of our WordPress hosting services and related features.

  1. Service Description

We provide managed WordPress hosting services that include server space, bandwidth, WordPress installation, maintenance, security features, and technical support as specified in your selected hosting plan.

  1. Account Registration and Requirements

3.1. You must provide accurate, current, and complete information during the registration process.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3. You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our services.

  1. Acceptable Use Policy

4.1. You agree not to use our services for any illegal or unauthorized purpose.

4.2. Prohibited activities include but are not limited to:

Distribution of malware or viruses

Phishing or fraudulent activities

Spamming or unsolicited mass communications

Copyright infringement

Hosting adult content without proper age verification

Excessive resource usage that impacts other customers

4.3. We reserve the right to suspend or terminate services if violations occur.

5.1. WordPress Software: Our services include the WordPress core software, which is licensed under the GNU General Public License.

5.2. Updates and Maintenance: We provide automatic WordPress core updates. Plugin and theme updates may be included depending on your plan.

5.3. Plugins and Themes: You may not install third-party plugins and themes.

5.4. Backups: We provide regular backups as specified in your plan. However, you are encouraged to maintain your own backups of your website content.

5.5. Resource Limitations: Each hosting plan includes specific resource allocations. Exceeding these limits may result in additional charges or service restrictions.

  1. Content Ownership and Licensing

6.1. You retain all ownership rights to your content hosted on our services.

6.2. You grant us a limited license to host, store, and display your content solely for the purpose of providing the hosting services.

  1. Privacy and Data Protection

7.1. Our collection and use of personal information is governed by our Privacy Policy.

7.2. We implement reasonable security measures to protect your data but cannot guarantee absolute security.

7.3. As a data processor, we comply with applicable data protection laws including GDPR where applicable.

  1. Payment Terms

8.1. Fees for services are due according to the billing cycle of your selected plan.

8.2. All payments are non-refundable except as expressly provided in this Agreement or required by law.

8.3. We reserve the right to modify our fees with 30 days’ notice.

  1. Term and Termination

9.1. This Agreement remains in effect until terminated by either party.

9.2. You may terminate at any time by canceling your account through your control panel or contacting customer support.

9.3. We may terminate this Agreement for cause without notice if you violate its terms.

9.4. Upon termination, you must pay any outstanding fees, and we will provide you with an opportunity to download your content.

  1. Limitation of Liability

10.1. Our total liability arising out of this Agreement shall not exceed the amounts paid by you for the services during the 12 months preceding the claim.

10.2. We are not liable for indirect, incidental, special, consequential, or exemplary damages.

  1. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of this Agreement.

  1. Modifications to Terms

We may modify this Agreement at any time by posting the revised terms on our website. Your continued use of our services constitutes acceptance of the modified terms.
